Actually, it isn't.  In the United States, not knowing that your product 
infringes on a patent is not a viable defense against charges of patent 
infringement.  This is preposterous, considering the impenetrable 
language of software patents, their broadness, and the sheer number of 
them, but it's the system.  Sad, isn't it?
