Wrong. Here's an extract from the license:

"b) You must cause any work that you distribute or publish, that in 
whole or in part contains or is derived from the OC or any part 
thereof, to be licensed as a whole at no charge to all third parties 
under the terms of this License, unless otherwise permitted under 
applicable Fair Use law."

Granted, they do not have to 'send it back', but they DO have to make 
their version available under the OCL as well.
